I. Introduction

The website www.mykingdom.com.vn (hereinafter referred to as the “Website”) is the official e-commerce site owned by Viet Tinh Anh Joint Stock Company (Enterprise Tax Code: 0309132354), headquartered at: 33–35 Street D4, Him Lam New Urban Area, Tan Hung Ward, District 7, Ho Chi Minh City.

This Policy is issued to ensure the rights and obligations of customers when accessing and using services on the Website, in accordance with applicable laws, especially Decree No. 13/2023/ND-CP on Personal Data Protection.

The contents of this document are intellectual property owned by Viet Tinh Anh Joint Stock Company. Any act of copying, citing, or reusing all or part of this document for commercial purposes without Viet Tinh Anh’s prior written consent may be subject to legal action in accordance with the law.

II. Definitions

  • “Account” means the login account on the website registered by the customer at www.mykingdom.com.vn.

  • “Customer” means any individual or organization that accesses, learns about, registers, performs access, uses products, services, utilities and/or has any relationship/transaction on the website www.mykingdom.com.vn.

  • “Personal Data Protection Terms” means this Privacy Policy and Personal Data Protection Terms.

  • “Personal data” means information in the form of symbols, letters, numbers, images, sounds or similar forms expressed in an electronic environment associated with a specific individual, including: full name, date of birth, gender, nationality, phone number, address, personal identification information and other related information.

  • “Processing of personal data” means one or more activities impacting personal data such as: collecting, recording, analyzing, verifying, storing, modifying, disclosing, combining, accessing, retrieving, revoking, encrypting, decrypting, copying, sharing, deleting, destroying, or any other related actions.

  • “Data subject” means the individual who is reflected through personal data.

  • “Company” or “Viet Tinh Anh” means Viet Tinh Anh Joint Stock Company, including its head office, branches, offices, and company websites.

  • “Mykingdom Website” or “Mykingdom Site” means the website owned by Viet Tinh Anh Joint Stock Company at www.mykingdom.com.vn.

  • “Third party” means any organization or individual that is not Viet Tinh Anh and is not the data subject.

  • “Cookie” means a small text file stored on the Customer’s device when accessing the website. Cookies record information such as IP address, traffic source (e.g. from search engines), and website usage behavior (such as how the Customer navigates the site). Viet Tinh Anh uses cookies and similar technologies to:
    • Support the access and use of services;
    • Personalize the experience according to the Customer’s settings;
    • Analyze and generate statistics on visiting activities on the Mykingdom website.

For clarity, any term not defined in this Privacy Policy and Personal Data Protection Terms shall be interpreted and applied in accordance with related internal regulations issued by Viet Tinh Anh from time to time and/or according to contracts, agreements, documents agreed between the Customer and Viet Tinh Anh, or interpreted under the laws of Vietnam.

III. General Provisions

  • This Privacy Policy and Personal Data Protection Terms form an integral and inseparable part of the payment process and all actions relating to Login or Registration on the Mykingdom website.

  • By providing personal data of a third party to Viet Tinh Anh through the Mykingdom website, the Customer represents, warrants and is responsible that the Customer has obtained the lawful consent of such third party for the processing and for informing them that Viet Tinh Anh is the personal data controller/processor for the purposes stated in this Privacy Policy and Personal Data Protection Terms.

  • The Customer understands and agrees that providing their personal data to Viet Tinh Anh via the Mykingdom website constitutes full acceptance and consent allowing Viet Tinh Anh and the Mykingdom website to use such personal data throughout the entire process of receiving and processing that personal data, from the moment Viet Tinh Anh receives the information until a valid request to cease processing is made by the Customer.

IV. Personal Data Processing Activities

  1. Collection of personal data

Viet Tinh Anh may directly or indirectly collect the Customer’s personal data through the following methods:

  • Directly from the Mykingdom website: when the Customer accesses, registers, uses available features or conducts transactions on the website.

  • Through contact and interaction with the Customer: via email, video calls, call center, electronic communications or any other communication channels.

  • Automatic recording: via cookies, plug-ins, third-party social network tools, and traffic logging systems.

  • From other sources that the Customer agrees to share/provide, or as required or permitted by law.

  1. Purposes of processing personal data

Viet Tinh Anh may collect, use and process the Customer’s personal data for one or more purposes to improve product and service quality and better meet the Customer’s needs and interests (collectively, the “Purposes”), including but not limited to:

  • Verifying, identifying, and checking the completeness and accuracy of information provided by the Customer; assessing and preventing risks related to acts of impersonation, suspected impersonation, fraud, or other violations of law.

  • Confirming and fulfilling orders, providing after-sales services, and improving customer experience. The act of placing an order by the Customer is deemed as consent for Viet Tinh Anh to create a customer account based on the information provided.

  • Providing, developing, managing, and measuring products, services, and utilities offered by Viet Tinh Anh.

  • Contacting, taking care of the Customer, receiving and handling requests, instructions or feedback from the Customer.

  • Conducting marketing, introducing and providing information to the Customer relating to products, services, promotional programs, surveys, market research or other trade promotion activities of Viet Tinh Anh, as well as products and services of partners cooperating with Viet Tinh Anh.

  • Conducting monitoring, inspection, audit, risk management, information security, system security, compliance management and other internal activities in accordance with Viet Tinh Anh’s policies, as well as complying with requests from competent State authorities in accordance with the law.

Viet Tinh Anh will request explicit consent from the Customer before using the Customer’s personal data for any purpose other than those stated in this Policy.

  1. Collection, transfer and disclosure of personal data

Viet Tinh Anh has implemented and is implementing appropriate technical and organizational measures to protect personal data from unauthorized access, collection, use or disclosure from its service systems.

Viet Tinh Anh commits not to trade, buy, sell or illegally exchange the Customer’s personal information in any form. However, to serve the Purposes set out in this Policy, the Customer understands and agrees that Viet Tinh Anh may disclose the Customer’s personal data, or personal data of third parties related to the Customer, to one or more of the following entities:

  • Staff and internal departments of Viet Tinh Anh for the Purposes stated in Section IV.2 of this Policy.

  • Stores, agents or member companies, affiliates, or related entities of Viet Tinh Anh.

  • Partners, strategic partners, service providers, or affiliated units for the above Purposes, including within the process of providing independent or integrated products and services of Viet Tinh Anh.

  • Competent State authorities as prescribed by law; or individuals/organizations such as lawyers, notaries, audit firms, credit rating agencies, etc. when necessary in specific cases and in accordance with the law.

  • Other third parties when there is separate consent from the Customer, or in cases where Viet Tinh Anh has legal grounds to share the Customer’s personal data in accordance with the law.

Viet Tinh Anh treats the Customer’s personal data as private and confidential information. Apart from the cases mentioned above, Viet Tinh Anh commits not to disclose the Customer’s personal data to any other third party.

V. Exercising Customer Rights and Obligations Relating to Personal Data

  • The Customer has the following rights:
    (i) Right to be informed;
    (ii) Right to consent;
    (iii) Right of access;
    (iv) Right to withdraw consent;
    (v) Right to delete data;
    (vi) Right to restrict data processing;
    (vii) Right to obtain data;
    (viii) Right to object to data processing;
    (ix) Right to complain, denounce, and initiate lawsuits;
    (x) Right to claim damages;
    (xi) Right to self-protection and other related rights as prescribed by law.

  • Viet Tinh Anh, using reasonable efforts, will execute lawful and valid requests from the Customer within the timeframe required by law from the time of receipt of complete and valid requests and related processing fees (if any), subject to Viet Tinh Anh’s rights to rely upon any exemptions and/or exceptions under the law.

  • In case the Customer withdraws consent, requests deletion of data and/or exercises other related rights in respect of any or all of the Customer’s personal data, and depending on the nature of such request, Viet Tinh Anh may consider and decide not to process the Customer’s request or not to continue providing products and services to the Customer because:
    (i) the law and/or competent authorities do not permit Viet Tinh Anh to do so; or
    (ii) Viet Tinh Anh cannot ensure the standards/quality of products and services if such data is deleted/restricted; or
    (iii) the law requires Viet Tinh Anh to collect the Customer’s personal data when providing products and services; or
    (iv) in other cases where, in Viet Tinh Anh’s assessment, deletion/restriction of data may disrupt system structure, data protection infrastructure, or historical customer information.

  • The Customer is responsible for self-protecting their personal data and requesting relevant organizations and individuals to protect their personal data. At the same time, the Customer must respect and protect the personal data of others.

  • The Customer must comply with regulations on personal data protection and participate in preventing and combating violations of regulations on personal data protection.

  • In case of any change or adjustment to their personal data, the Customer is responsible for accessing the Mykingdom website to proactively check and update such personal data, or contacting and promptly notifying Viet Tinh Anh so that the Company can timely update those changes or adjustments. The Customer shall bear full responsibility for any delay in updating or notifying Viet Tinh Anh of changes to such personal data.

VI. Protective Measures and Risks in Case of Personal Data Breach

Viet Tinh Anh always respects privacy rights and endeavors to protect and secure the Customer’s personal data as one of its most important assets. Viet Tinh Anh strives to ensure confidentiality, safety, legal compliance, and to minimize any possible unwanted consequences or damages. Viet Tinh Anh fulfills its obligation to protect personal data in accordance with current laws, using security methods consistent with legal requirements and market practices, and regularly reviews and updates its management and technical measures when processing the Customer’s personal data (if any).

The Customer understands that providing and consenting to Viet Tinh Anh’s use and processing of personal data always entails potential risks, such as partial data leakage or processing that may be inappropriate or delayed, arising from causes including but not limited to: system errors, transmission failures, force majeure events, viruses, cyberattacks, hardware or software failures, actions or manipulations by the Customer or any third party affecting the provision and processing of the Customer’s personal data.

VII. Duration of Processing and Retention of Personal Data

  • The duration of personal data processing is not dependent on whether or not the Customer conducts transactions with Viet Tinh Anh via the Mykingdom website and/or has terminated/ceased using products, services or contracts/agreements established between the parties.

  • This Privacy Policy and Personal Data Protection Terms remain in effect from the time the Customer’s personal data is recorded on the Mykingdom website system until the Purposes specified in Section IV have been fulfilled or upon the occurrence of circumstances terminating data processing as prescribed by law.

  • The Customer’s personal data collected and stored by Viet Tinh Anh will be kept confidential. Viet Tinh Anh is committed to taking reasonable technical measures to ensure safety and prevent unauthorized access, use, disclosure or alteration of stored personal data.

VIII. Effect, Notification, Amendments and Supplements

  • By using any product, service or accessing the Mykingdom website, the Customer is deemed to have agreed to and accepted this entire Privacy Policy and Personal Data Protection Terms. If the Customer does not agree with the contents of this Policy, the Customer has the right to send a written notice to Viet Tinh Anh requesting termination of the use of products and services or to stop accessing the websites.

  • If, after sending a termination notice, the Customer continues to use products, services or access the Mykingdom website, the Customer is deemed to have withdrawn their objection and agreed to this Privacy Policy and Personal Data Protection Terms.

  • Viet Tinh Anh reserves the right to amend, update or adjust the content of this Privacy Policy and Personal Data Protection Terms from time to time, ensuring that such amendments and supplements comply with current laws. Notices of amendments, updates or adjustments will be sent by Viet Tinh Anh to Customers via one or more of the following methods: public announcement on the Mykingdom website, Viet Tinh Anh’s email, SMS to mobile subscribers, or other methods deemed appropriate by Viet Tinh Anh.
